1. Introduction and Acceptance of Terms
Welcome to Walka. These Terms and Conditions ("Terms") govern your access to and use of the Walka mobile application ("App") and related services (collectively, the "Service") provided by Walka ("we", "us", or "our").
By creating an account or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
2. Eligibility
The App is intended for users who are at least 13 years of age. By using the App, you represent and warrant that:
You are at least 13 years old;
You have the legal capacity to enter into a binding agreement; and
Your use of the App does not violate any applicable law or regulation.
If you are between 13 and 17 years of age, you confirm that you have obtained the consent of a parent or legal guardian to use the App.
3. Important Health and Medical Disclaimer
⚠️ DISCLAIMER: Walka is not a medical device and does not provide medical advice, diagnosis, or treatment. The step recommendations and weight loss guidance provided by the App are for informational and motivational purposes only and are not a substitute for professional medical advice. Always consult a qualified healthcare professional before starting any new exercise or weight loss programme, particularly if you have a pre-existing health condition.
You acknowledge and agree that:
You use the App entirely at your own risk;
Walka is not responsible for any injury, illness, or adverse health outcome arising from following the App's recommendations;
Step targets provided by the App are general estimates and may not be appropriate for everyone; and
You should stop exercising and seek medical advice if you experience pain, dizziness, shortness of breath, or any other concerning symptoms.
4. User Accounts
To access the App, you must register for an account using a valid email address. You agree to:
Provide accurate, current, and complete information during registration;
Keep your account credentials confidential and not share them with any third party;
Notify us immediately at contact@tundealao.com if you suspect any unauthorised access to your account; and
Take responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate your account if we reasonably believe that you have breached these Terms or that your account has been compromised.
5. Subscription and Payments
5.1 Subscription Plans
Walka is offered on a subscription basis. Details of available subscription plans, pricing, and billing cycles are set out within the App. Subscriptions provide access to the features of the App for the duration of the chosen subscription period.
5.2 Billing
Your subscription will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
5.3 Cancellation
You may manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no refund will be issued for any unused portion of the subscription period, except as required by applicable law.
5.4 Price Changes
We reserve the right to change our subscription prices. We will provide you with reasonable notice of any price changes. Continued use of the App after a price change constitutes your acceptance of the new price.
6. Data Collection and Privacy
We collect and process the following personal data in order to provide the Service:
Email address — used for account creation and communication; and
Daily step count data — used to generate personalised step recommendations.
We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For full details of how we collect, use, store, and protect your data, and your rights as a data subject, please refer to our Privacy Policy, available within the App.
By using the App, you consent to the collection and processing of your data as described in our Privacy Policy.
7. Acceptable Use
You agree not to use the App in any way that:
Violates any applicable law or regulation in the United Kingdom or your country of residence;
Is fraudulent, deceptive, or misleading;
Infringes the intellectual property rights of Walka or any third party;
Attempts to gain unauthorised access to any part of the App or its related systems;
Introduces malware, viruses, or other harmful code; or
Interferes with or disrupts the integrity or performance of the App.
8. Intellectual Property
The App and all of its content, features, and functionality — including but not limited to software, text, graphics, logos, and design — are owned by Walka and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the App for your personal, non-commercial use, subject to these Terms. You must not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
9. Limitation of Liability
To the fullest extent permitted by applicable law:
Walka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App;
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the total amount paid by you to us in the 12 months preceding the claim; and
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Your statutory rights as a consumer under UK law are not affected by these Terms.
10. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the App. Upon termination, your right to use the App will cease immediately.
You may terminate your account at any time by cancelling your subscription and contacting us at contact@tundealao.com to request account deletion.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via the App or by email to the address associated with your account. The updated Terms will be effective from the date they are posted. Your continued use of the App after that date constitutes your acceptance of the revised Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
